PLEASE READ THESE TERMS OF SERVICE CAREFULLY. C&W FENCING (“COMPANY,” “WE,” “US,” OR “OUR”) OWNS AND OPERATES THIS WEBSITE AND ANY RELATED PAGES, ESTIMATE FORMS, CUSTOMER PORTALS, COMMUNICATION SYSTEMS, OR SERVICES PROVIDED BY C&W FENCING (COLLECTIVELY, THE “WEBSITE” OR “SERVICES”). THESE TERMS OF SERVICE (“TERMS”) APPLY TO ALL USERS OF THE WEBSITE AND SERVICES, INCLUDING CUSTOMERS, WEBSITE VISITORS, ESTIMATE REQUESTS, AND ANY PERSON ACCESSING OR USING OUR SERVICES, CONTENT, OR COMMUNICATIONS. BY ACCESSING THIS WEBSITE OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
Payments
Payment is due according to the schedule listed on the invoice or contract. Deposits are required before scheduling or ordering materials and are non-refundable. Final payment is due upon project completion unless otherwise agreed in writing. Accepted payment methods may include check, ACH transfer (1% additional fee), or credit/debit card (2.99% additional fee). If payment is not received when due, C&W Fencing may charge a late fee of up to 1.5% per month (18% annually) or the maximum amount permitted by Washington State law, whichever is less. Any returned payments may be subject to additional bank fees.
Accounts that remain unpaid may be subject to suspension of work, collection costs, reasonable attorney fees, and lien filing as allowed under Washington law.
Liability
Customer is responsible for confirming property lines, HOA approvals, sprinkler systems, or concealed site conditions before work begins. The Company will call to locate and identify underground utilities prior to construction. The company is not responsible for damage to unmarked underground items or conditions outside its control. Customers must keep children, pets, and personal property away from active work areas. Warranty coverage applies only to workmanship and does not include damage caused by weather, misuse, ground movement, vandalism, or lack of maintenance.
Privacy
Customer information collected through estimates, invoices, CRM systems, or website forms is used solely for business operations, scheduling, communication, and payment processing. Customer information will not be sold or shared with third parties except as required to complete services or comply with legal obligations.
Disputes
Any disputes arising from services or contracts shall first attempt to be resolved through good-faith communication between both parties before legal action is pursued. Any legal proceedings shall take place in the state and county where services were performed unless otherwise required by law.
Cancellations
Cancellations must be submitted in writing. Deposits remain non-refundable once contract is signed. Last-minute cancellations and will be subject to rescheduling fees. The company reserves the right to reschedule work due to weather, material shortages, unsafe conditions, or circumstances beyond its control.
Acceptance
By signing or approving an estimate, the customer acknowledges they have read, understood, and agreed to these terms and conditions.
